Ukrainians who travel to their country of origin risk losing their residence permit in Norway

The Ministry of Justice and Public Security today issued instructions to the Norwegian Directorate of Immigration (UDI), enabling the UDI to revoke temporary collective protection if Ukrainians travel to their country of origin.

Міністерство юстиції та надзвичайних ситуацій сьогодні видало інструкцію для Директорату у справах іноземців (UDI), згідно з якою UDI може скасувати тимчасовий колективний захист, якщо українці відвідують батьківщину.
Виходячи із загальної інструкції Міністерства юстиції та надзвичайних ситуацій для UDI (GI-03/2020), іноземці, яким надано захист у Норвегії, можуть втратити дозвіл на проживання, якщо вони повернуться до країни, з якої втекли.
Донині для українців із тимчасовим захистом діяв виняток із цієї інструкції (Г-07/2022). Зараз цей виняток скасовується, і таким чином обмежується можливість українців подорожувати до рідної країни без наслідків.
– Якщо українці з тимчасовим колективним захистом подорожують між Норвегією та Україною, то це означатиме, що вони більше не потребують захисту в Норвегії. Віднині я хочу ставитися однаково як і до українців та і до представників інших національностей, коли йде мова про наслідки які виникають в результаті від таких поїздок, – каже міністерка юстиції та надзвичайних ситуацій Емілі Енгер Мель.
Поїздки, здійснені до набрання чинності цієї інструкції, не призведуть до скасування дозволу. У дуже особливих випадках можливість відвідати рідну країну буде збережена.
This results from a general instruction from the Ministry of Justice and Public Security to the UDI (GI-03/2020) that foreign nationals who have been granted protection in Norway can lose their residence permit if they return to the country they have fled from.
Until now, there has been an exemption from this instruction for Ukrainians (G-07/2022) with temporary collective protection. This exemption is now being withdrawn, and Ukrainians’ ability to travel to their country of origin without consequences will be restricted.
‘If Ukrainians with temporary collective protection travel back and forth between Norway and Ukraine, this may indicate that they no longer need protection in Norway. I now want to treat Ukrainians and other nationalities on an equal footing in terms of the consequences of such journeys,’ said Minister of Justice and Public Security Emilie Enger Mehl.
Journeys made before the instructions entered into force will not result in revocation. In extraordinary cases, visits to the country of origin will still be permitted.
